1. Acceptance of Terms
By accessing or using the Service, you confirm that you are at least 13 years of age (or 16 in certain jurisdictions), that you have read and understood these Terms, and that you agree to be legally bound by them. If you do not agree, do not use the Service. Users in Canada agree that these Terms, together with our Privacy Policy, constitute the entire agreement between you and My Perfect Dates.
2. Description of Service
My Perfect Dates is a couples date planning application that offers AI-generated date recommendations, collaborative planning tools, budget tracking, Google Calendar integration, and a shared memory scrapbook. Features may be updated, modified, or discontinued at any time without prior notice.
3. Account Registration
You must create an account to access most features of the Service. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any suspected unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.
4. User Content
You retain ownership of any content you submit to the Service, including photos, notes, and date memories ("User Content"). By submitting User Content, you grant My Perfect Dates a limited, non-exclusive, royalty-free license to store, display, and process that content solely to provide the Service to you and your invited partner. You agree not to submit content that is unlawful, harmful, defamatory, or that infringes the intellectual property or privacy rights of others.
5. AI-Generated Recommendations
The Service uses artificial intelligence to generate date ideas and recommendations. These suggestions are provided for informational and entertainment purposes only. We do not guarantee the accuracy, availability, safety, or quality of any recommended venues, activities, or services. Users are solely responsible for verifying details, making reservations, and ensuring their safety before acting on any recommendation.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable US or Canadian law or regulation
- Attempt to gain unauthorized access to any portion of the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the app
- Use the Service to harass, abuse, threaten, or harm any person
- Transmit viruses, malware, or any other harmful or disruptive code
- Use automated tools to scrape, crawl, or collect data from the Service without our express written permission
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
7. Intellectual Property
All content, features, and functionality of the Service -- including but not limited to text, graphics, logos, icons, and software -- are the exclusive property of My Perfect Dates and are protected under applicable US and Canadian intellectual property laws, including the Copyright Act (Canada) and US copyright law. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
8. Third-Party Integrations
The Service may offer integrations with third-party platforms such as Google Calendar. Your use of those integrations is subject to the terms and privacy policies of the respective third parties. We are not responsible for the availability, accuracy, or conduct of any third-party service.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law -- including in Canada under the Consumer Protection Act and equivalent provincial legislation -- we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
10. Limitation of Liability
To the maximum extent permitted by law in both the United States and Canada, My Perfect Dates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of -- or inability to use -- the Service. Nothing in these Terms limits liability that cannot be excluded under applicable Canadian consumer protection law. Our total liability for direct damages shall not exceed the greater of (a) the amount you paid us in the past twelve (12) months or (b) $50 CAD/USD.
11. Indemnification
You agree to indemnify and hold harmless My Perfect Dates and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or any applicable law.
12. Termination
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination -- including Sections 7, 9, 10, 11, and 13 -- will remain in effect.
13. Governing Law & Dispute Resolution
For US Users: These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding individual arbitration in accordance with the American Arbitration Association (AAA) rules. Class action lawsuits are waived to the extent permitted by law.
For Canadian Users: These Terms are governed by the laws of Canada and the province in which you reside, without regard to conflict of law principles. Disputes that cannot be resolved informally may be referred to mediation or, if necessary, to the courts of the applicable Canadian province. Nothing in these Terms removes your rights under mandatory Canadian consumer protection laws.
14. Language
These Terms are written in English. For Quebec users: Les parties reconnaissent avoir exige que cette entente et tous les documents connexes soient rediges en langue anglaise. (The parties acknowledge having requested that this agreement and all related documents be drafted in English.)
15. Changes to Terms
We may revise these Terms at any time. Material changes will be communicated through the app and by updating the effective date. Your continued use of the Service following notice of changes constitutes acceptance of the revised Terms.
